According to Texas State Law, a person is legally intoxicated with a .08 BAC (blood or breath alcohol concentration). A person may also be legally intoxicated if sufficiently impaired even if the BAC is below .08, or if they are impaired due to other drugs. Drivers and passengers can be fined up to $500 for possessing an open alcohol container in a vehicle.
